Tracelia Terms of Service

Welcome to Tracelia. These Terms of Service ("Terms") govern your access to and use of the website located at tracelia.com (the "Site") and related pre-launch services, including our waitlist and newsletter (collectively, the "Services").
Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access the Service.
1. Provider & Scope
The Service is owned and operated by the founder of the Tracelia project:
(Note: The formal business entity for Tracelia is currently under formation. Until the entity is fully incorporated, the Service is operated by the Tracelia project, represented by its founder.)
B2B Intent: The Tracelia project is designed for business professionals and entities. While the current Site is accessible to the public, the future SaaS platform is intended solely for B2B use.
2. Access and Use of the Service
2.1. Nature of Current Services
Currently, Tracelia is in a Pre-Launch / Marketing phase. The Service is limited to:
- Providing information about the planned Digital Product Passport platform.
- Allowing users to join the "Waitlist" or "Founder's Club".
- Distributing newsletters and updates.
2.2. No Account Registration Yet
The Site does not currently support full user account registration, password management, or dashboard access. Any references to "Accounts" or "Dashboards" on the Site are illustrative of future functionality.
2.3. Free Access
Access to the Site and joining the Waitlist is currently free of charge. We reserve the right to introduce paid subscription plans for the full SaaS platform in the future.
3. Intellectual Property
3.1. Our Content
All content on the Site, including text, graphics, logos, images, and software code, is the property of Tracelia or its content suppliers and is protected by copyright and intellectual property laws.
3.2. Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal or internal business information purposes. You may not resell, reproduce, or modify any part of the Site without our express written consent.
3.3. User Feedback
If you provide us with any ideas, suggestions, or feedback regarding the Tracelia platform ("Feedback"), you grant us a perpetual, irrevocable, royalty-free, worldwide license to use, modify, and incorporate such Feedback into our products and services without any obligation or compensation to you.
4. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws or regulations.
- Infringe upon the intellectual property rights of others.
- Transmit any viruses, malware, or harmful code.
- Attempt to gain unauthorized access to our servers or systems.
- Scrape or collect data from the Site using automated means (bots) without our prior written consent.
5. Disclaimers Regarding Future Products
IMPORTANT:
The descriptions of features, modules (e.g., "Digital Product Passport Generator"), and capabilities presented on the Site reflect our development roadmap and vision.
- We do not guarantee that all described features will be available in the initial version of the product.
- We reserve the right to modify specifications or cancel planned features without prior notice.
- Content on the Site does not constitute a binding commercial offer under the Polish Civil Code.
6. Limitation of Liability
To the maximum extent permitted by applicable law:
- "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the availability, accuracy, or reliability of the Site.
- No Liability: Tracelia (and its founder) shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of the Site or inability to access it.
- External Links: The Site may contain links to third-party websites (e.g., LinkedIn, X/Twitter). We are not responsible for the content or practices of these external sites.
- Force Majeure: We shall not be liable for any failure or delay resulting from events beyond our reasonable control, including outages of third-party infrastructure providers.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Poland. Any disputes arising under these Terms shall be resolved amicably. If an amicable resolution is not possible, disputes shall be submitted to the courts competent for the seat of the Provider (Warsaw, Poland).
8. Changes to Terms
We reserve the right to update these Terms at any time. Significant changes will become effective upon posting to the Site.
Note: Upon the commercial launch of the full Tracelia SaaS platform, these Terms will be replaced by a comprehensive SaaS Subscription Agreement covering billing, SLAs, and data processing in detail.
